An Abbotsford woman is suing 91原创 Township, claiming she suffered a broken foot and other injuries after a fall at the George Preston Recreation Centre.
According to the lawsuit, which was filed on June 3 in B.C. Supreme Court in Chilliwack, the woman was walking through the ice rink area when "she tripped and fell on uneven flooring, causing injuries."
The fall allegedly caused a broken right foot, injuries to her right leg and hip, her back and neck, her right shoulder, and headaches and anxiety.
The lawsuit claims that the uneven floor was a hazard and that the Township failed to ensure that the woman would be safe in using the premises.
She is claiming damages for pain and suffering, sleep disturbance, and a loss of enjoyment of life, as well as for necessary future care, her impairment of her ability to care for herself and her family via homemaking, and for various friends and family members who have taken on expenses for her personal care and for taking on her household responsibilities.
The claim did not set a dollar value on the financial claims.
The Township filed its response to the lawsuit on July 21, denying all of the allegations.
The response also says that the Township "had an appropriate and reasonable policy in place with respect to the inspection, maintenance, and repair of the premises, including but not limited to the floor of the premises.
It also alleged that the facility, including the flooring, was "in a reasonable state and condition for the safe use of all visitors."
None of the claims in either filing has been tested in a court of law.
